MDPD Officer Who Made Viral Facebook Video

 MIAMI (CBSMiami) – Veteran Miami-Dade Police Officer Lydia Marquez said it was an innocent question from her 4-year-old son that convinced her to make a Facebook video that has been seen and shared tens of thousands of times since she posted it on Thursday. She said her son asked her why she was going to work.
Her response, “Because Mommy cares. Mommy cares.”
She used that video as a platform to describe why she’s an officer, how race doesn’t matter to officers and the dangers many officers feel exist today that didn’t exist before.
“When I received my badge, I swore an oath,” she said in the video. “I swore that I would protect and serve all people – not blacks, not whites. Not all that. The oath is colorblind.”
Marquez’s words are one more element of a struggle that is occurring nationally, where many communities appear at odds with police as some citizens believe police officers are unfairly treating minorities while officers are feeling threatened and targeted.
Marquez says the targeting of officers nationwide like the shooting death of Harris County Deputy Darren Goforth in Houston and the shooting death of Illinois police officer Lt. Joe Gliniewicz leave her and other officers fearing for their safety more than ever.
“When I kiss my children in the morning before I go to work and tell them I love them I don’t know if I’ll be coming back at the end of the day, I don’t know especially nowadays,” she said. “It’s hard. It’s really hard.”
Friday afternoon CBS4 News met the woman behind the Facebook post.
“I spoke for those of us who couldn’t and I’m proud of that,” she said. “Thank you so much for everyone’s support. It’s been phenomenal.”
Marquez said it took her days and lots of courage to say what she did but she realized that even if other officers couldn’t speak their minds, she had to.
Her comments came just hours before someone smashed a window in a Miami-Dade Police car outside the officer’s home in Miami Springs.
Earlier this year, someone torched two South Florida police cars in front of their homes and someone shot up two other police cars.
“The fact that we’re targeted – because we are being targeted – you don’t go ‘eeny, meeny, miny, moe’ and pick the police car to break into it,” she said. “The stress we already deal with is large and with everything that’s happening it has grown so luck that I’m amazed how most of us officers are coming to work.”
She believes there is a segment of the population that sees police officers as the enemy but she said that won’t change what she does.
“I can’t quit on everybody and that alone gives me more strength,” she said.
Ultimately, she hopes the community realizes it’s not police working against citizens but instead working with them.
“We’re here to help you,” she said. “We’re here to protect you. We’re here for you. And people forgot that. And I want to remind them.”

  I need to set something straight. I am NOT a Saint. As you know I have been with Miami Dade Police Department for 20 years. NO, I HAVEN'T BEEN SITTING BEHIND A DESK MY WHOLE CAREER. When I graduated from the academy I was trained by my Field Training Officers the old school ways. In other words, either you sink or swim. I swam like a fish. I've worked the bad areas and the better ones. I've been shot at. I've been in more fights than I care to think about. A few of them, I thank God for all the defensive tactics courses I've taken at our Training Bureau. (OUR TRN COURSES FOR SHOOTING AND DEFENSIVE TACTICS ARE AWESOME.)I destroyed my knee in one of those fights and needed my ACL replaced. I cracked a molar straight down the center after getting clocked. I had to have it surgically removed. I've had my share of crashes. Some my fault but most were not. I drive my marked unit from one end of the district to the other. (I've had surgery on my spine due to 1 of those crashes after I lost feeling in my leg. Thru the years I've had my back injected a couple of times for the pain.) I've been in the Emergency room due to one injury or another a couple of times. I have my good days and not so good days. You try wearing our duty belts for 8, 10, 12 hours a day. The average weight is about 20 lbs give or take a few. Oh, don't forget our Bullet proof vest. Yea... Summer is not my favorite season in the year. Don't forget I live in Florida. Winter is a joke here in Miami. Ever had a heat rash? I've had a few thru the years.
I've been given verbal reprimands and written ones. (crashes, court and violating our rule books.) I give face and accept my reprimands when I know I screwed up. I've saved lives and I've seen people die infront of me. I spoke up after my brothers were killed brutally because I needed too tell you the truth about being a Cop and the sacrifices our families make for us and you. Go ask an officer about those sacrifices. How many family events missed like birthdays and holiday's in order to protect the roads for you. We all have our own stories to tell.
But you ask why "I" do it after the few things I wrote? Maybe it's because in my little world, I want to make it a better place for my children and yours. I adore the people I work with. I love my job and YES I definitely care about people. But I am NOT a Saint. But I am a COP and damn proud of being part of OUR family in Blue.

I have been a police officer for over 20 years and put this badge on hoping that I come home at night. I have been shot at, attacked with knives and even intentionally bitten by a guy with full blown AIDS. I am now more afraid to go out in this uniform than I have ever been. Yes, we get scared. and yes we are all scared now more than ever. Please keep fighting for us and I will continue to fight to make your community a safer place...










 

Mo. cop kicked out of Olive Garden because of duty gun

A hostess caught sight of Officer Michael Holsworth’s holstered handgun as he waited for his family and asked the decorated officer to leave the restaurant at once, he ranted in a Facebook post Sunday afternoon.
“I never in my wildest thoughts would of thought this would happen in the Kansas City area. I see it happening all over the United States to other officers, but never thought it would of happened to me,” he wrote after leaving the restaurant.
It’s legal to openly carry handguns in Missouri, but the Olive Garden hostess told Holsworth guns were prohibited in the restaurant.
The restaurant’s refusal to serve Holsworth brought on a flurry of outrage spearheaded by the city’s Fraternal Order of Police, which promised to organize protests outside the southeast Kansas City restaurant.
The order’s president, Brad Lemon, and Kansas City Police Chief Darrl Forte came to Holsworth’s defense in public messages aimed at the chain’s national Twitter account.
“Facts are being gathered,” Forte wrote.
It’s not clear why the restaurant franchise took a stance against Holsworth’s gun. Olive Garden insists it was a misunderstanding.
“Law enforcement are always welcome to dine (with) us — we heart serving them and have great relationships,” an Olive Garden spokesman said.
The chain’s president, Dave George, has since called Holsworth to apologize, said Lemon, the order's liaison to Kansas police.
Lemon took a pointed stand against Holsworth’s treatment, demanding respect for all law enforcement officers.
“It's been an incredibly difficult day for our brother, and our entire family. All we ever ask is to be treated fairly and with the same respect to due anyone else. When we are treated poorly because of our chosen occupation, it hurts,” Lemon wrote in another statement to Facebook.
“It's not okay to treat law enforcement poorly. We deserve, and have earned, the same level of respect due to each and every member of society.”
Holsworth declined to speak of Sunday’s ordeal further after his public Facebook post went viral with more than 5,600 shares.
Holsworth earned his department’s Distinguished Service Medal in 2014 for being one of three police officers who shot and killed a burglar linked to a triple homicide, according to city records.

'We Don't Serve Cops Here' 








As seen on Fox and Friends A Connecticut Dunkin’ Donuts quickly apologized to a local police officer who was told he would not be served at the location. The store's manager said his employee was just joking when she reportedly said, “He didn’t get the message. We don’t serve cops here," in front of other customers. The comment prompted the West Hartford police officer, who’d been waiting in line, to walk out in disgust. As he headed for his car, the manager brought the employee over to apologize, and the worker explained the comment was made in jest.
As part of the apology, the worker reportedly offered a free cup of coffee. But the officer would have none of it and said he’d take his business elsewhere. Dunkin’ Brands Group said that that the crew member showed poor judgment and that Dunkin’ franchises are committed to fair treatment of their customers. The incident comes after employees at Arby’s and Whataburger refused service to police officers in separate episodes in September.

Female Officer Attacked By Black Motorist – Thrown Down Steep Embankment, Manhunt Underway

A police officer was assaulted and thrown down a steep embankment in Schuylkill County, PA. Officer Melissa Ruch sustained injuries which were not reported to be life-threatening.
A little before 6pm on Friday, the West Penn Police Officer was traveling on Route 309 north when she came upon a disabled or parked vehicle on the side of the road next to the guard rail. She stopped to investigate, and as she did, a black male came around the vehicle, picked officer Ruch up and threw her down the steep embankment.
Ruch’s “officer down alert” was triggered, with units from all over the area converging immediately on the scene. By the time they arrived the assailant had fled in the vehicle but a concentrated effort is underway to locate and apprehend him.
Many area roads have been closed as the search for the assailant continues. Ruch says she was able to tase the perpetrator, evidence which may become useful in a positive identification once he is caught.

The latest reported sexting episode from disgraced former New York Congressman Anthony Weiner allegedly involved a 15-year-old girl, and now the NYPD is reviewing the case.

According to a law enforcement source, both Manhattan NYPD special victims unit and the Manhattan District Attorney office are reviewing the case since the allegations involve a defendant from New York.
“Both Manhattan SVU and the DA prosecutors are reviewing the case over the allegations regarding the online messages the minor brought forth to the online publication,” the source tells Breitbart News. “A review is being done to determine if a criminal investigation is warranted. Even if the minor refuses to press charges, the state can go forward in investigating the allegations and Weiner could be facing criminal charges.”
The minor, whose name is being withheld due to her age, told the Daily Mail that she and the former congressman carried on a relationship for several months since last January via numerous social media services such as Twitter, Facebook, Kik, Confide and Skype. The girl claims that Weiner sent nude photos, shared pornographic videos with her, discussed his “rape fantasies,” and requested that she undress and masturbate during video chats.
“He had some rape fantasies. It would just be him showing up at my house when my dad was out of town,” the girl told the Daily Mail. “And just start undressing me, being forceful, asking me if I want to be dominated, strange questions.”
When asked if they are pressing charges against Weiner, the girl and father expressed no interest in doing so. “Her mental health is in jeopardy,” the father told the Daily Mail. He said they wanted to bring this story out to the public “for concern that Weiner may be sexting with other underage girls.”
“If there’s anybody out there that has a similar story that they can come forward, maybe use my daughter’s example to have the courage to come forward.”
However, these allegations can lead to criminal charges if police see probable cause in the girl’s reported age and the type of exchanges that reportedly occurred. If the girl undressed during the alleged Skype video chats with Weiner, the former congressman might be charged with child pornography.
“Even sending a minor anything sexual can result in Weiner being charged,” the source told Breitbart when asked if Weiner could be facing charges.
According to NY Penal Law, Article 235, obscenity and related offenses is a class D Felony, a criminal prosecution Weiner can face for “dissemination of indecent material to minor.” Sexual material or persuading a minor to engage in sexual conduct online can result in 2-7 years in prison.
The Daily Mail obtained purported screenshots that the girl saved of their correspondences. Many include shirtless pictures of Weiner, with one picture of his shirt rolled up, exposing his stomach with his toddler son curled up next to him. The article states that one message from Weiner to the teen says: “I would bust that tight p***y so hard and so often that you would leak and limp for a week.”
The girl alleges that Weiner was aware she was underage and in high school.
The exchange began in January when the girl reached out to Weiner via Twitter direct message. She says that she was “obsessed” with the pervy congressman and wanted to write a book about him.
Around April, the girl came forward and told her teacher and father about the months-long sexting exchange, claiming she felt “guilty about hiding the relationship.” She wrote a letter to her dad, and told Weiner what she did. Weiner then allegedly pressured the girl to send a redaction letter to her teacher and father, saying she lied about the whole relationship and they were just friends. The girl agreed to do what Weiner allegedly ordered her to do but says she sent the message to a fake email address.
“After I told my teacher about the relationship, [Weiner] wanted me to email my dad and my teacher and tell them that was [sic] I said was false,” she said. “That the conversations were appropriate and were never inappropriate, and he was very helpful.”
However, the two continued to talk until July. By August, the girl came forward after the New York Post reported on Weiner sexting another woman, displaying his toddler son in one suggestive photo.
“After seeing what he did with his son having him in the picture that was released, I think that he’s very disgusting and he needs help,” she said.
Weiner released a statement to the Daily Mail, saying that someone perpetrated “a hoax” against him. However, he did not deny exchanging flirtatious messages with the minor.
“I have repeatedly demonstrated terrible judgement [sic] about the people I have communicated with online and the things I have sent,” Weiner’s statement reads. “I am filled with regret and heartbroken for those I have hurt. While I have provided the Daily Mail with information showing that I have likely been the subject of a hoax, I have no one to blame but me for putting myself in this position. I am sorry.”

Alison Parker

Alison Parker is WDBJ7’s Mornin' reporter. She isn't too far
from home, having lived most of her life outside of Martinsville, Va.
Alison is also a former WDBJ7 intern.


She formerly worked at WCTI NewsChannel 12 in the Jacksonville, N.C., bureau, which is near Marine Corps Base Camp Lejeune.

Alison
graduated from James Madison University in Harrisonburg, Va. in
December 2012. She learned the ropes of journalism in JMU's School of
Media Arts and Design. During her last semester in school, she learned
how to produce newscasts at WHSV, an ABC/Fox affiliate station in
Harrisonburg.


Alison was also News Editor for JMU's nationally recognized newspaper, The Breeze, which has received numerous press awards.

In her spare time, Alison likes to whitewater kayak, play with her parents' dog Jack, and attend community theater events.

Virginia Shooting Spotlights Riddle of Workplace Safety

The problems were flagrant, and his boss began to document them, only months after Vester Lee Flanagan II started working as a reporter at television station WDBJ in Roanoke, Va.
He had a “heated confrontation” with another reporter inside a station truck, according to a memo from the news director. He ripped into a cameraman because he did not like the way he was filming, and colleagues said he made them feel “threatened or uncomfortable.” Mr. Flanagan was ordered to obtain counseling from employee assistance or lose his job. He complied, but because of continuing belligerence and other problems he was fired anyway, after less than a year.
Mr. Flanagan stormed out of the news director’s office when told he was being dismissed and slammed a door so hard that nearby workers hid in a locked room. Station officials called the Roanoke police, who came to escort him out, but not before he handed the news director a small wooden cross and said, “You’ll need this.”

The station hired off-duty police officers to guard the building for the next two days and hoped that the problems with Mr. Flanagan were over.
But they were not: More than two years after being fired, Mr. Flanagan shot to death Alison Parker, a young reporter, and Adam Ward, a cameraman he had once worked with, while they were on the air Wednesday on assignment.
It is a nightmare for any employer: what to do with a volatile, constantly aggrieved worker who has had angry, even frightening confrontations with fellow workers — yet has committed no crime. Because he had no convictions or been adjudicated mentally ill, Mr. Flanagan was able to legally purchase from a licensed dealer the Glock 19 handgun used in the killings after passing a background check in June, federal officials said.
At a news conference on Thursday, the station manager of WDBJ was asked if there was anything more the station could have done to protect its workers. “We can probably screen more,” the manager, Jeff Marks, said, though he went on to speak about how difficult it is to get an honest reference from a former employer.
Finally, he said, “I don’t know the answer to that question, nor do I think I’m likely to come up with it in the first day” after the shooting.
Such violent events cannot be predicted, but there are things a company can do to reduce the risk of them occurring, according to labor scholars, psychologists and consultants in workplace safety.
Suggestions include forming teams to monitor and provide help to workers who seem to be boiling over with bitterness and, if firing is necessary, doing so in a way to preserve the worker’s dignity as much as possible, said J. Reid Meloy, a psychologist and consultant on workplace risk.
Employers face conflicting legal obligations and huge uncertainties. They have a legal duty to provide a safe workplace, and can even be sued for failing to prevent predictable threats, according to legal experts.
On the other hand, they must tread carefully with employees who may have mental health problems. The federal disabilities act prohibits discrimination against disabled people, including those with mental illness.
For every angry employee who might pose a serious threat, there are far more who will not and whose privacy and rights must be respected. And there is no surefire screening method.
“It’s nuance,” said Linda Doyle, an expert in employment law with McDermott Will & Emery in Chicago. “Not every one of these is a Mr. Flanagan,” she said, referring to people whose behavior seems problematic. “The goal is to help the person be well and change the behavior, but the other goal is to protect your workplace.”
Many companies refer troubled workers to employee assistance programs, which provide counseling or refer them to therapists or other programs. But therapists are bound by confidentiality unless the patient makes a clear, immediate threat to harm himself or someone else.
According to the federal government, nearly two million Americans each year report being victims of workplace violence, a broad definition that includes not just physical violence, but also threats, harassment, intimidation and even verbal abuse involving employees, clients, customers and visitors.
From 1997 to 2010, there were 8,666 homicides in workplaces, of which about one in 10 were carried out by co-workers or former co-workers, federal data shows. Total homicides in the workplace have been declining, to about 400 in 2013, according to the most recent statistics from the Department of Labor.
Federal law since the 1970s has made it clear that employers are responsible for providing work sites that are free of hazards, which government rules and court decisions have established can include workplace violence, said Corinne Peek-Asa, associate dean for research in the College of Public Health at the University of Iowa and director of the university’s Injury Prevention Research Center.
“If you can convince a jury that a business should have seen it coming, and should have done something about it, more often those cases are going against the employer, especially jury decisions,” Ms. Peek-Asa said.
Many larger companies have devised systematic approaches to prevent workplace violence, “but there are huge gaps in the programs of many middle- and small-sized businesses,” she said.
Dealing with employees whose anger and aggression may be tied to psychiatric disorders poses special challenges. Under the Americans With Disabilities Act, employers must accommodate workers who have mental health issues as long as they are able to do their job, and employers can be sued for revealing medical information to a third party, said Joseph A. Seiner, an expert on employment issues and a professor at the University of South Carolina School of Law.
Still, “employers do not have to tolerate acts of violence,” said Elizabeth Bille, vice president and associate general counsel at the Society for Human Resource Management. “Even if a behavior such as a threat of violence is the result of a mental health condition,” she said, employees can be terminated.
“This is one of the most complicated areas of human resources or employment law because there are no clear answers,” Ms. Bille said, “and there a few potential legal pitfalls you need to navigate.”
Many experts agree that employers should take more care when firing a volatile person than when dismissing a typical employee, and if necessary with severance benefits that might not otherwise be warranted. Still, some people may continue to nurture their grievances no matter how their firing was handled.
“You can try to know as much as you can about the person before they depart,” said Stephen G. White, a psychologist and president of the consulting firm Work Trauma Services Inc. Employers can have precautionary measures in place when it seems appropriate, such as legal protective orders. But in the end, he said, comes a very difficult judgment call.
“You’re looking for that needle in the haystack,” Mr. White said. “You don’t want to miss a hot one, but you don’t want to overreact to situations that are low risk.”
At WDBJ, Mr. Flanagan was not just a difficult employee, he was a litigious one. He filed an Equal Employment Opportunity Commission complaint of discrimination against the station. He also sued the station after his dismissal and sought to subpoena the personnel records of 41 employees, including his own file and those of Ms. Parker, Mr. Ward and several of his bosses.
In a rambling fax he sent to ABC News on Wednesday that amounted to a suicide note, he accused employees of the station of racist acts “including, but not limited to a watermelon being left on a cooler ON PURPOSE. It was left there a day after I complained about a photographer asking if I wanted to get a watermelon Slurpee when I asked him to pull over at 7/11. This was not an innocent act.” He saw malice in an intern asking where he would “swing by” for lunch.
Mr. Marks, the station manager, said at a news conference Thursday: “We do not tolerate any attitude of illegal discrimination, harassment, or anything that makes the workplace other than a safe place to work,. We have terminated employees for violating that standard, and we would again.”
He added, “I am absolutely certain that nothing like that happened in this case, and that it was in the imagination, and perhaps in the preconception and the preplanned attitudes, of the fellow in this case.”
